Acceptable Use Policy

This Acceptable Use Policy (“AUP”) governs your use of the RESI platform at re-si.co.za. It forms part of, and must be read together with, our Terms of Use. By using the Platform you agree to use it lawfully and in accordance with this AUP. Breach of this AUP is a material breach of the Terms of Use and may result in suspension or termination of your access.
1. Who This Applies To
This AUP applies to every account holder — a landlord using RESI to manage their own residential rental portfolio — and to anyone who accesses the Platform through their account.
2. Permitted Use
RESI is a software tool for recording and managing your own residential rental records: properties, tenants, leases, payments, expenses, documents, and rental income summaries for your SARS ITR12 filing. You may use the Platform only for this purpose and only in a lawful manner.
3. Prohibited Conduct
You must not:
- use the Platform for any unlawful purpose, or in breach of any applicable law or regulation (including POPIA, the Rental Housing Act, and tax legislation);
- enter personal information about any person, including a tenant, without a lawful basis to do so;
- post, upload, store, or transmit any content that is abusive, defamatory, harassing, threatening, racist, discriminatory, obscene, or otherwise objectionable;
- infringe the intellectual property or other rights of RESI or any third party;
- introduce malware, or use any software, routine, or device to interfere with, disrupt, or impair the operation, integrity, or security of the Platform;
- attempt to gain unauthorised access to the Platform, to another user's workspace, account, or data, or to circumvent any access control or security measure;
- scrape, harvest, or extract data from the Platform by automated means beyond your own account's normal use and data-export features;
- reverse engineer, decompile, or attempt to derive the source code of the Platform, except to the extent this restriction is prohibited by law;
- use the Platform to send unsolicited bulk communications, or to harass or intimidate tenants or any other person;
- resell, sublicense, or use the Platform for any commercial purpose other than as expressly permitted by RESI; or
- misrepresent your identity, or your authority to act on behalf of any company or person.
4. Prohibited Business Uses
RESI is a record-keeping tool for legitimate residential rental activity. It does not hold, pool, or transmit tenant or third-party funds. You must not use the Platform:
- to facilitate, conceal, or record money laundering, terrorist financing, fraud, or any other financial crime;
- to process, disguise, or document the proceeds of any unlawful activity;
- in connection with any illegal goods, services, or business;
- to evade tax, or to create or misrepresent financial records submitted to SARS or any other authority; or
- to operate any scheme that is deceptive or harmful to tenants or other third parties.
5. Your Responsibilities in Respect of Tenant Data
Where you use the Platform to process personal information about your tenants, you act as the Responsible Party under POPIA. You must have a lawful basis for collecting and processing that information, must have informed your tenants where required, and must comply with all applicable provisions of POPIA. You must not use the Platform to process any person’s personal information unlawfully.
6. Reporting Misuse
If you become aware of any use of the Platform that breaches this AUP, please report it to us at support@re-si.co.za.
7. Consequences of Breach
If you breach this AUP, we may — in addition to our other rights under the Terms of Use — remove offending content, restrict or suspend your access, terminate your account (immediately where the nature of the breach warrants it), report the conduct to the relevant authority, and pursue any available legal remedy.
8. Changes to This Policy
We may update this AUP from time to time. The current version will always be available on the Platform, and your continued use of the Platform constitutes acceptance of the policy as amended.
